Please read the Terms and Conditions agreement carefully before accessing or using the information and services available through the Learn Drive Survive SDC (“Site”). By using this website, you agree to abide by the terms and conditions set out in this Agreement. If you do not agree to abide by these terms and conditions do not use this website.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

In no event shall we be liable for any direct, indirect, incidental, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data, lost opportunities, arising out of or in any way connected with the use or performance of our services. Under no circumstances will Learn Drive Survive SDC be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including without limitation, incorrect email addresses, internet failures, computer equipment failures, other equipment failures, or non-performance of third parties.

You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Learn Drive Survive SDC contains certain material which is owned by or licensed to us. Any such material includes, but is not limited to, design, layout, graphics or overall appearance. Any reproduction of the content contained within Learn Drive Survive is prohibited under Copyright legislation or unless otherwise indicated and that you agree not to infringe any intellectual property rights owned by Learn Drive Survive.

Any reproduction or redistribution of any of the contents in any such form is prohibited however, other than the following:

  • Print and download for non-commercial but for personal use only,
  • You may copy the content to individual third parties for their personal use, but only if you acknowledge the website as the source of the material.
  • You are prohibited to reproduce, distribute, or commercially exploit any of the content unless you have received our express written authorisation to do so.
  • You are prohibited from transmitting or storing the content onto other website or other forms of digital retrieval systems apart from learndrivesurvivesdc.com.au

Any products or services purchased from Learn Drive Survive SDC will only be commenced upon receipt of payment has been received and all appropriate information and material has been received from the customer.

Learn Drive Survive SDC regards customer privacy as an important part of our relationship with our customers. The following privacy policy applies to all Learn Drive Survive SDC users, and conforms to Internet privacy standards. MODIFICATIONS TO THE SERVICE

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, suspension or discontinuance of the Service.

Please Note: TfNSW set specific course requirements which include but not limited to a minimum number course participants set for both modules.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

VEHICLE LIABILITY

If you fail to follow all reasonable directions provided by the coach during the practical driving component (Module 2), you will be responsible for the lower of the cost of repairs relating to any damage caused or the insurance excess applicable, should the vehicle be damaged for whatever reason. If for any reason, your actions, whether they are intentional, reckless or careless, cause any damage to vehicles or property of Learn Drive Survive SDC or the property of another, you will be liable for the cost of repairs relating to damage caused or the insurance excess applicable.

If you breach any road rules during the course of your lesson, you will be responsible for traffic infringement notices arising while driving our vehicle/s.

BOOKING THE SAFER DRIVERS COURSE

Any payments for the Safer Drivers Course, must be paid online using our secure encrypted payment gateway, before the commencement of the course. The Safer Drivers Course can also be booked by contacting us on 1800 898 969.

LICENCE STATUS

You agree that at the time of booking and/or commencing the Module 2 component of the SDC, that you do not have a disqualification, cancellation, suspension or pending charge against you in NSW or elsewhere or your licence is subject to an appeal for driving offences. You also agree that at the time of booking and/or commencing the Module 2 component of the SDC, that your drivers licence is valid and current. 

CANCELLATIONS / LATE AND/OR NO-SHOW / CHANGE OF BOOKING

We understand that from time to time that students may need to reschedule or cancel their booking. When you book the Safer Drivers Course with Learn Drive Survive SDC, you are securing a spot for a specific time and date as well as the facilitators and/or coaches time. Where a participant needs to re-schedule a session and provides more than 7 days notice, we will make every effort to re-book them for a future session. If the participant is unable to re-book any other available dates, Learn Drive Survive SDC will provide a full refund of the course fee less 25% administration processing fee. If a participant needs to cancel or re-schedule a booking and provides less than 7 days notice, no refund or re-schedule will be offered.  

PLEASE NOTE: Learners must meet all eligibility criteria for the course. Therefore, all log books with a minimum of 50 actual hours of driving must be presented to the LDS facilitator/coach upon arrival for verification. If a student fails to have their current drivers licence on them, they will not be able to drive. Any participants failing to meet the eligibility criteria, will forfeit the entire course fee.

Module One – Group Discussion

A lot of time and effort is required in preparing and organising a single Safer Drivers Course. This includes time of the course provider as well as facilitators and coaches, who allocate their time away from other driver training duties. Therefore, there are additional late notice and cancellation fees to cover administration   and re-organising of course participants. 

  1. If a participant cancels their Module One session and provides less than 7 days notice before the commencement of the session, no refund will be offered. However, if a participant decides to re-schedule, they will be required to pay an additional $75.00. If the participant is unable to re-book any other available dates no refund will be provided.
  2. If a participant simply fails to attend a scheduled Module One session, no refund will be provided.

Module Two – In-Car Coaching

The Module Two component of the course requires two (2) participants at any given time. Where a participant needs to re-schedule this session and provides more than 48 hours notice, every effort will be made to re-book a future session.

  1. If your Module Two Coaching session is cancelled with less than 24-hours notice before the commencement of the session time, the requirements of the SDC will not be met and the full course fee will not be refunded.
  2. If a participant wants to reschedule their Module Two Coaching Session once arrangements have been confirmed with the student (either via SMS or email), an additional $75.00 will be required to re-book. Your cancellation affects the trainers time and commitment as well as the other participant as they are unable to complete the coaching session alone.
  3. If for any reason one participant is unable to continue with Module Two, all attempts will be made to fulfill the session for the second participant.
  4. If a participant simply fails to attend a scheduled Module Two session, no refund will be provided and an additional $75.00 will be required to re-book.

Please note, a 25% administration processing fee is applicable to all eligible requested refunds.

COVID INFORMATION

It is no longer a legal requirement for people diagnosed with COVID-19 to isolate.

Please note: The same Cancellation, No- Show, Change of Booking conditions apply with any Covid related matters.

 SAFER DRIVERS COURSE PROVIDER TRAINING (for driving instructors)

1. Cancellations / Re-booking / Late or No Shows

a. You must provide at least 7 business days notice if you are unable to attend the training session/s. Cancellations can be made via email (bookings@learndrivesurvivesdc.com.au), phone (1800 898 969) or Facebook messenger. Cancellation fees will apply if sufficient notice is not provided.

25% administration processing fee will apply to all refunds.

b. Participants that choose to re-book another course date can only do so with no less than 7 days’ prior notice.

c. Late or failing to attend session training at the commencement of any safer driver course training sessions will result in the participant having to re-book another course date and paying the full fee.

d. Participants accept responsibility for the pre-requesites of the Safer Drivers Course suitability. Please contact the office if you are uncertain about the course suitability.

e. Learn Drive Survive make every effort to ensure training courses are run as per schedule however, on occasions it may be necessary to cancel or re-shedule courses due to insufficient participant numbers. If this occurs, Learn Drive Survive will offer you alternative course dates based on availability and convenience. If we are unable to come to an alternate course date, you will be provided with a full refund.

CANCELLATION OF COURSES OR SESSIONS BY LEARN DRIVE SURVIVE

Learn Drive Survive reserve the right to cancel or reschedule course dates under certain circumstances (e.g. unable to meet minimum participant numbers, sick facilitators or coaches, dangerous weather conditions, etc). In the event of postponement or re-scheduling of a course date or session, any fees paid will be carried forward to the next course date or refunded upon your request. Learn Drive Survive SDC will provide a full refund of the course fee less 25% administration processing fee.

The coach reserves the right to cancel a session immediately if they suspect on reasonable grounds that the participant is under the influence of any substance or any other condition that impairs their ability to drive safely. The coach also reserves the right to cancel the session if the pacrticipant does not follow the coaches instructions or does anything which is unsafe or dangerous and there is an obvious danger to other road users, members of the public or property.

In such circumstances, the full course fee is forfeited.

GIFT VOUCHERS

If you purchase a gift voucher from Learn Drive Survive SDC, it can be redeemed for up to year (3) years from the time of purchase. If your gift voucher exceeds the three (3) period from the time of purchase, any unused value remaining on the voucher is forfeited. You understand that your gift voucher is transferrable however, is non-refundable. It has no cash redemption value and cannot be exchanged for cash.

BOOK NOW PAY LATER

No upfront payment when booking the ‘Book Now Pay Later’ option. Minimum weekly amount is payable to Learn Drive Survive® until full fee has been paid. CANCELLATIONS/LATE AND OR NO SHOWS / CHANGE OF BOOKINGS terms are the same for the Book Now Pay Later option.

PHOTOS IN SOCIAL MEDIA

When participants complete the Safer Drivers Course, Learn Drive Survive obtain several photographs during Module One and Module Two for marketing purposes on social media platforms such as Facebook and Instagram. If you do not wish to have your photograph published by any means whatsoever, please advise your facilitator and/or coach.
